EAST CHICAGO | It remained unclear Saturday whether the mother of a 1-year-old baby who was found on the roof of her home is in police custody.
Lake County prosecutors charged Araceli Gutierrez, 32, of East Chicago, last week with felony neglect charges after her 1-year-old son was found sobbing on the roof of their home.
A warrant was issued for Gutierrez's arrest Tuesday, but as of Saturday night, she was not in custody at the Lake County Jail.
East Chicago police referred questions on the case to city spokesman Damian Rico, who did not provide answers to The Times.
It also could not be confirmed whether the state had taken the baby into protective custody.
Gutierrez was asleep June 6 when police and firefighters arrived at her home in the 3800 block of Elm Street, Lake County Criminal Court records state.
A witness called 911 after seeing the baby crying on the roof, police said. The boy had climbed to the roof of the front porch from the second-floor apartment window, court records say.
The witness went up to the roof and took the 1-year-old down before public safety officers arrived.
When police arrived, the child was back in the living room, wearing a dirty T-shirt and diaper, and food was found strewn on the floor, cabinets and sink, court records say.
The home had no toilet, and Gutierrez told police the family used the closet as a bathroom, records say.
