CRIMINAL JUSTICE : Defendant argued prosecutors went back on plea deal by filing second case
Times Staff Report
INDIANAPOLIS | The Indiana Court of Appeals on Friday upheld the conviction of a Gary child molester who claimed he was double crossed by Lake County prosecutors.
Kashmir Bray, 31, agreed last February to plead guilty to child molestation, child exploitation and vicarious sexual gratification charges in exchange for a 30-year prison sentence. While Bray awaited sentencing, a second underage victim went to Gary police with additional allegations.
Lake County prosecutors filed a molestation charge on the second allegation. Bray claimed he was coerced into accepting the plea deal and prosecutors violated the agreement by filing a charge on the second allegation.
Prosecutors said that charge had nothing to with the initial case, and the appeals court agreed.
Bray no longer faces the second molestation charge. Lake County court records show that prosecutors dropped that case in December.
