School rules for expulsion after alleged fight with substitute teacher

LAKE STATION | The two students suspended last month for allegedly taking part in an after-school fight with a substitute teacher will not be readmitted this school year, attorneys for the teens said.

An Edison Junior-Senior High School hearing officer on Monday recommended, after a hearing held last week, that both teens be expelled through June 8, 2009, based on testimony and evidence presented, according to attorneys Todd Conover and Alex Dominguez.

Conover said his client, who is a senior, most likely won't appeal the decision.

He said the teen most likely will be looking to attend an alternative school so he can complete his high school degree.

"It's unfortunate because he's already missed a lot of school," Conover said.

Dominguez, whose client is a high school junior, said he hadn't had the opportunity to completely review the decision rendered on Monday. He wasn't certain whether the decision would be appealed.

Lake Station Community Schools Superintendent Dan DeHaven couldn't be reached for comment.

The teens received school suspensions following an Oct. 15 incident with substitute teacher Hiram Alamo, 54, of Lake Station.

Following the incident, Lake Station police filed two separate cases -- one with Lake County Juvenile Court in Crown Point and one with Lake Station City Court.

Prosecutors reviewed the case against the teens and decided there wasn't enough evidence to charge them, Police Chief Mike Stills said.

Alamo was charged in Lake Station City Court with two misdemeanor battery charges.

Stills said the teens maintain the Alamo followed them and they were just defending themselves after he challenged them outside one of the student's home.

Alamo, who was knocked unconscious during the incident, told police the teens had followed him and retaliated because of a disciplinary incident at school.
