Hammond band teacher to undergo psych evaluation

HAMMOND | A Hammond band teacher will undergo a psychological evaluation before he faces charges of having sex with an eighth-grade girl, a federal judge ruled Monday.

Though his client objected, defense attorney Stephen Scheele asked the judge to order the evaluation to determine if suspended Clark Middle/High School band teacher James Ciammetti, 41, of Oak Lawn, Ill., was legally insane at the time of his alleged federal crimes.

Magistrate Judge Paul Cherry granted the request. Ciammetti faces federal child enticement and pornography charges on top of state charges he had sex several times with a 14-year-old girl.

Even as Scheele asked for the evaluation, Ciammetti voiced resistance. Ciammetti told Cherry he has adjusted to his routine in the Lake County Jail, and he doesn't want to travel for the evaluation.

"I've gotten accustomed to some of the rules and what is expected at the county jail," Ciammetti said. "Further change from that, I would not like."

Cherry closed to the public a portion of the hearing that dealt with Scheele's specific reasons for requesting the evaluation.

"Suffice to say, I have some concerns as to mental health issues for my client," Scheele said.

Ciammetti faces federal charges he sexually enticed a minor, crossed state lines for sex acts with a minor, made child pornography and transported images of child pornography across state lines. He has not entered pleas to those charges.

Ciammetti pleaded not guilty in September in Lake Criminal Court to two counts of child molesting, two counts of sexual misconduct with a minor and one count of child solicitation. He is scheduled for a hearing in county court in July.
